2. Scope of Services
Informatiks specialises in the supply and installation of residential and commercial security and automation systems. These systems may include CCTV and monitoring technologies that capture and record images, video, and, where applicable, audio data. Artificial Intelligence (AI) features may also be integrated to enhance system functionality.
3. Ownership of Data
All data captured by installed systems—including images, video recordings, audio, and related information—remains the sole property of the customer. Informatiks does not claim ownership of any data generated by systems installed at customer premises.
4. Compliance with New Zealand Privacy Laws
Informatiks operates in accordance with the principles of the Privacy Act 2020 and supports customers in understanding their obligations when using surveillance systems.
Customers are responsible for ensuring that their use of CCTV and surveillance equipment complies with applicable privacy laws, including but not limited to:
- Collecting personal information only for lawful and necessary purposes
- Ensuring surveillance is not unreasonably intrusive.
- Providing clear notification (e.g., signage) where surveillance is in operation.
- Respecting individuals’ rights to access their personal information where applicable.
Guidance on privacy obligations can be obtained from the Office of the Privacy Commissioner.
5. Data Storage and Security
Data collected by security systems is stored either:
- Locally on recording devices (e.g., NVR/DVR), or
- On cloud platforms under accounts managed by the customer
Systems are protected by secure login credentials. Customers are solely responsible for safeguarding usernames and passwords and must not share them with unauthorised parties.
6. Access to Systems and Data
Informatiks does not store or have access to customer passwords. Access to system data is strictly limited to circumstances where:
- The customer has requested technical support, and
- Explicit permission has been granted.
Any access is used solely for troubleshooting, maintenance, or system optimisation.
7. Password Management
Customers are responsible for maintaining the confidentiality of their login credentials. Informatiks can assist with password resets upon request if credentials are lost or forgotten.
8. System Features and AI Capabilities
Our systems may include features such as:
- Human Detection
- Facial Recognition
- Vehicle Detection
- Licence Plate RecognitionCrowd Detection
- Heat Detection
Facial Recognition and similar features will only be enabled upon the customer’s explicit request and must be used in compliance with applicable privacy laws.
9. Audio and Video Recording
Our systems can record both video and audio. Audio recording is optional and will only be enabled based on customer preference and in compliance with New Zealand legal requirements.
10. Data Retention and Storage Capacity
Storage capacity and retention periods are configurable and determined by customer requirements. Customers are responsible for ensuring that retention practices comply with legal obligations, including not retaining personal information longer than necessary.
11. No Data Storage by Informatiks
Informatiks does not store, collect, or retain any video, audio, or other data recorded by systems installed at customer premises. All data remains under the customer’s control.
12. Website Privacy
We respect the privacy of our website visitors. Informatiks does not record video or collect visual data from website users. Any analytics used do not involve video surveillance or image recording.
13. Customer Responsibilities
Customers are responsible for:
- Ensuring lawful use of surveillance systems
- Protecting login credentials
- Complying with the Privacy Act 2020 and other applicable regulations
- Informing employees, visitors, or members of the public where surveillance is in operation (e.g., signage)
- Responding to requests for access to personal information, where required by law.
14. Policy Updates
Informatiks reserves the right to update or modify this policy at any time to reflect changes in legal requirements, technology, or business practices. Updated versions will be published on our website.
15. Scope of Work & Installation
Informatiks will supply and install security and automation systems as agreed in the project scope, quotation, or contract.
- All installations are carried out in a professional manner in accordance with industry standards.
- Any variations to the agreed scope may result in additional charges and will be communicated to the customer prior to proceeding.
- Customers must ensure safe and reasonable access to the installation site, including access to power and network infrastructure where required.
16. Customer Responsibilities (Installation & Usage)
The customer agrees to:
- Provide accurate information regarding site conditions and requirements.
- Ensure the installation environment is safe and compliant with applicable regulations.
- Obtain any necessary permissions, consents, or approvals (e.g., landlord, body corporate)
- Use the installed system in compliance with all applicable laws, including privacy obligations.
- Maintain internet connectivity where remote access or cloud features are required
17. Warranty
Informatiks provides a limited warranty on supplied equipment and installation workmanship:
- Equipment Warranty: Covered as per the manufacturer’s warranty terms.
- Workmanship Warranty: Covers installation defects for a specified period (typically 12 months unless otherwise stated)
The warranty does not cover:
- Damage caused by misuse, negligence, or unauthorised modifications.
- Power surges, electrical faults, or environmental factors (e.g., water damage, extreme weather)
- Issues arising from third-party equipment or software not supplied by Informatiks.
- Normal wear and tear
Warranty claims must be reported promptly with proof of purchase.
18. Technical Support & Maintenance
- Technical support is available upon request and may be subject to service fees outside warranty coverage.
- Ongoing maintenance services, if required, will be provided under a separate agreement.
- Informatiks may access systems remotely or on-site only with customer authorisation for support purposes.
19. Limitation of Liability
To the maximum extent permitted by law:
- Informatiks shall not be liable for any indirect, incidental, or consequential damages, including loss of data, loss of business, or loss of profits.
- Informatiks does not guarantee that installed systems will prevent all security incidents, theft, or unauthorised access.
- Customers acknowledge that security systems act as a deterrent and monitoring tool but do not eliminate all risks.
Liability, where applicable, is limited to the value of the products and services supplied.
20. System Performance & Connectivity
- System performance may depend on external factors such as internet connectivity, power supply, and third-party services.
- Informatiks is not responsible for disruptions caused by outages, network failures, or cloud service providers.
- AI-based features are subject to environmental conditions and may not always achieve 100% accuracy.
21. Data Responsibility & Backup
- Customers are solely responsible for managing and backing up their data where required.
- Informatiks is not responsible for data loss due to system failure, storage limitations, or user actions.
- Customers are advised to regularly check system functionality and storage capacity.
22. Payment Terms
- Payment terms will be outlined in the quotation or invoice.
- Informatiks reserves the right to require a deposit prior to commencing work.
- Full payment may be required upon completion unless otherwise agreed.
- Late payments may incur additional charges or suspension of services.
23. Cancellations & Changes
- Any cancellation or rescheduling of installation must be communicated in advance.
- Informatiks reserves the right to charge for costs incurred due to last-minute cancellations or changes.
- Custom-ordered equipment may not be eligible for cancellation or refund.
24. Health & Safety
- Informatiks complies with relevant New Zealand health and safety regulations during installation.
- Customers must ensure a safe working environment for technicians.
- Any hazards must be disclosed prior to installation.
25. Governing Law
These Terms & Conditions are governed by the laws of New Zealand. Any disputes arising shall be subject to the jurisdiction of New Zealand courts.
